Amid global patent applications hitting all-time highs, patent competition in the AI semiconductor sector is intensifying.

2026 is off to a hot start. According to the Korean Intellectual Property Office (KIPO), domestic intellectual property filings in January 2026 totaled 56,458, representing an increase of about 39% compared to 40,679 in January of the previous year, marking the largest scale ever recorded for the month of January.
By right type, patents increased by 45.2% year-on-year to 23,365, trademarks rose 39.5% to 28,085, designs grew 10.9% to 4,773, and utility models increased 50.6% to 235.
KIPO stated that this sharp surge is interpreted as a trend extending beyond a mere base effect. The analysis indicates that as AI technology spreads, one-person startups centered around ICT and information service industries have become active, leading to an increase in corresponding patent filings.
Additionally, the "AI Index 2026" published by Stanford HAI (Human-Centered AI Institute) on April 13, 2026, provided a new international evaluation of South Korea's AI patent competitiveness. According to the report, South Korea recorded 14.31 AI patents per 100,000 residents, securing the world's number one spot for the second consecutive year following the previous year. Luxembourg (12.25), China (6.95), and the United States (4.68) followed.
The Stanford HAI report evaluated that South Korea stands out in terms of AI innovation density. The same report noted that the United States still produces more top-tier AI models and high-impact patents, while China leads in paper publication volume, citation counts, patent application volume, and industrial robot installations.

The strong momentum in 2026 builds upon solid performance in 2025. According to annual statistics for 2025 released by KIPO in January 2026, domestic patent applications in South Korea totaled 260,797, a 5.9% increase from 246,245 the previous year, surpassing 260,000 for the first time in history. Achieving over 260,000 annual patent applications is a milestone accomplished by South Korea as the fourth country globally, following Japan (1984), the United States (1999), and China (2008).
Looking at the 2025 domestic patent application growth rate by applicant type, increases were observed across all categories in the following order: individuals (15.0%), mid-sized enterprises (13.7%), large enterprises (5.6%), and small and medium-sized enterprises (4.6%).
By technology field, remarkable advances were made in cutting-edge technology sectors. From January to October 2025, ICT-related patent filings encompassing AI and quantum technology rose 21.1% year-on-year to 27,033, while the secondary battery sector also reached 10,624—a 14.4% year-on-year increase—led by major enterprises such as LG Energy Solution, Samsung SDI, and SK On.
Overseas filings also increased significantly. Based on data from January to September 2025, patents filed by domestic companies in the IP5 offices totaled 67,025, up 17.6% from the same period last year. The proportion of US filings was the highest at 49.2%, while filings in China recorded the steepest upward trend with a 72.3% increase.
A recovery is also evident in registrations. According to the "Intellectual Property Statistics FOCUS, Vol. 26" (November 2025) published by KIPO and the Patent Statistics Center of the Korea Institute of Intellectual Property (KIIP), domestic intellectual property registrations in the first half of 2025 increased across all four rights—patents, utility models, trademarks, and designs—with total registrations rising 13.9% year-on-year.

Viewing the Stanford HAI "AI Index 2026" and Clarivate's "Top 100 Global Innovators 2026" report (January 2026) together clearly reveals the triangular structure of AI patent competition among the US, China, and South Korea.
According to the Clarivate report, mainland China's share of surveyed AI inventions was approximately 74%, claiming an overwhelming first place in AI invention scale (667,589 cases). This figure is about 4.3 times higher than the combined total of the US, Europe, and the UK (153,551 cases).
However, superiority in volume does not mean superiority in influence. According to the same report, in terms of high-intensity AI inventions in the top 0.5% based on global citations and multinational filings, the US, Europe, and the UK led with 1,137 cases compared to China's 882 cases. Among high-intensity AI inventions, the proportion of generative AI in China stood at 45%, outpacing the 27% recorded by the US, Europe, and the UK.
Considering the high-intensity AI invention data presented by Clarivate (global citation and multinational filing rates), it can be interpreted that strategies to elevate citation and multinational filing rates rather than mere application volume are core to practical competitiveness. The same report revealed that 16% of high-intensity AI inventions originate from the Top 100 Global Innovators, suggesting that AI patent competition is reorganizing around quality rather than quantity.
While South Korea ranked first globally in population-adjusted AI patent density, some point out that there is room for improvement regarding the international influence of its patents.
According to domestic analyses interpreting the Stanford HAI report, it has been pointed out that South Korean AI patents exhibit relatively slow initial citation speeds post-registration and a high proportion of uncited patents, with the report citing differences in citation practices and home-bias effects as causes of this phenomenon. However, this evaluation is based on secondary commentary by domestic media rather than the original report text, and the original HAI text needs to be separately reviewed to verify exact figures and methodologies.
[Global Background] Global Patent Applications Reach Approx. 3.7 Million in 2024, Highest Growth Rate Since 2018
To understand why South Korea's performance in 2025–2026 is significant, it must be viewed within the global context.
According to the WIPO "World Intellectual Property Indicators 2025" (based on 2024 performance, published in November 2025), global patent filings in 2024 reached approximately 3.7 million, increasing by 4.9% compared to 2023 and recording the highest annual growth rate since 2018.
Asian intellectual property offices handle 70.1% of worldwide filings, a 10.1 percentage point increase from 60% a decade ago in 2014. Within Asia, four countries—China, India, Japan, and South Korea—accounted for 95.2% of total Asian patent filings.
According to the same report, China's share surged from 34.6% in 2014 to 49.1% in 2024, whereas the US share declined from 21.6% to 16.2% over the same period. Worldwide patent filings by Indian applicants increased by 19.1% in 2024, continuing a double-digit growth streak for the sixth consecutive year.

According to "Intellectual Property Statistics FOCUS, Vol. 26" (KIPO and KIIP, November 2025), foreign intellectual property filings in the domestic market during the first half of 2025 increased by 5.7% year-on-year. Among these, filings by Chinese applicants surged 22.0%, while filings by US applicants—who held the largest share—decreased by 2.6%, showing contrasting trends. The increase in domestic patent filings by Chinese applicants was centered around electrical engineering fields such as electrical machinery and energy, audio and video, and semiconductors.
Regarding this, KIPO mentioned slowing domestic market growth within China and US-China trade conflicts as background factors, explaining that this reflects moves by Chinese companies to utilize South Korea as a strategic base in terms of technology and markets.
[Registration Quality] South Korea Maintains Highest Overseas Patent Grant Rate Among IP5
According to KIPO press releases, as of 2023, the proportion of patents actually registered (grant rate) among those reviewed by the US and European offices for South Korean applicants was 85% and 78.1%, respectively, the highest figures among IP5 countries and maintaining a gap of over 5 percentage points with the second-place country.
According to WIPO "IP Facts and Figures 2024" (August 2024, PPP basis), South Korea recorded 7,309 resident patent applications per 100 billion dollars of GDP based on PPP in 2023, the highest figure among major nations, showing a substantial gap with second-place China (4,875 cases) and third-place Japan (3,974 cases).
